Please read these Terms and Conditions carefully. By ordering or using any of our services, you agree to be bound by this Agreement, including our Privacy Policy and Acceptable Use Policy, which are incorporated by reference.

1. Introduction

This Agreement is between Evolving Media & Design Inc. (referred to as “Evolving Media”, “we”, “us”, or “our”), a federally incorporated Canadian company, and the individual or entity named on the Order Form (“Customer”, “you”, or “your”).

It governs your purchase and use of all services (the “Services”) ordered through our website, order forms, or other channels we provide.

By submitting an Order Form or using the Services, you accept this Agreement. We reserve the right to reject any order for any reason. Activation of the Services confirms our acceptance of the Agreement.

You represent and warrant that:

• If you are an individual, you are at least 18 years old; or
• If you are a business entity, you are duly organized and in good standing, and the person accepting this Agreement is authorized to do so on your behalf.

We reserve the right to refuse service to anyone.

2. Changes to This Agreement

We may update or modify these Terms from time to time. We will post the updated version on this page with a new “Last Updated” date.

We may also notify you by email of material changes. If you do not agree with any material change, you must cancel your subscription before the change takes effect (see Section 3 – Cancellation/Termination). Your continued use of the Services after the change takes effect constitutes your acceptance of the updated Terms.
