At Evolving Media & Design, we embrace Artificial Intelligence (AI) as a powerful tool to enhance creativity, streamline processes, and deliver exceptional value to our clients. This policy outlines how we responsibly integrate AI into our workflows to benefit client projects while safeguarding intellectual property, including copyrights and trademarks.

Following other design associations in Canada, the Association of Registered Graphic Designers requires us to post our AI Policy. This policy will evolve as new AI abilities emerge.

 

1. Use of AI as a Tool
In certain circumstances, Evolving Media & Design may use AI to amplify our creative and operational capabilities, ensuring high-quality outcomes for clients.

Specific applications may include:  

  • Ideation and Inspiration:
    AI tools assist in generating concepts, mood boards, and design drafts to spark creativity and align with client visions.

  • Content Optimization:
    AI enhances copywriting, editing, and SEO to improve clarity, engagement, and visibility.

  • Design and Production:
    AI supports graphic design, video editing, and animation by automating repetitive tasks, allowing our team to focus on bespoke creativity.

  • Data Analysis:
    AI may process client data to provide insights for targeted campaigns, user experience improvements, and performance tracking.

  • Efficiency:
    AI streamlines project management, scheduling, and resource allocation to deliver assignments on time and within budget.

2. Commitment to Client Benefit

Evolving Media & Design employs AI to:

3. Protecting Copyrights and Trademarks
To uphold intellectual property rights and avoid infringement, we adhere to the following guidelines:

  • Originality Verification:
    Evolving Media & Design thoroughly reviews AI-generated content (e.g., text, images, designs) to ensure the algorithms do not replicate existing copyrighted or trademarked material. We cross-reference outputs with reputable databases and tools to confirm originality.

  • Licensed Tools:
    We use only AI platforms and tools with clear licensing agreements that permit commercial use and indemnify against infringement risks.

  • Client IP Protection:
    Any client-provided materials (e.g., logos, brand guidelines, proprietary content) are handled with strict confidentiality and are not used to train AI models or shared with third-party platforms.

  • Custom Outputs:
    AI-generated deliverables are uniquely tailored for each client and undergo human oversight to avoid generic or derivative content that could infringe on existing works.

  • Trademark Compliance:
    Evolving Media & Design does not use AI to generate or create designs or branding elements; we may use AI tools to brainstorm the creation of slogans.

    As of 2025, AI-created works cannot be trademarked.

    When designing a hand-crafted company logo or brand, a NUANS search is conducted at current rates unless declined by the client.

  • Transparency:
    If AI is used to create elements of a deliverable, we inform clients and provide assurances that the output complies with intellectual property laws.

 

4. Ethical AI Practices  

  • Bias Mitigation:
    We select AI tools designed to minimize bias and regularly audit outputs to ensure fairness and inclusivity in content and designs. 

  • Data Security:
    Client data used in AI processes is encrypted and stored securely, complying with applicable privacy regulations (e.g., GDPR, CCPA).
     
  • Human Oversight: AI is a tool, not a replacement for human creativity. Our team vets, edits, and approves all AI outputs to ensure quality and alignment with client expectations.

 

5. Accountability and Continuous Improvement  

  • Evolving Media & Design attempts to remain current about evolving AI regulations, copyright laws, and trademark policies to ensure compliance. However, there is no guarantee. What may work in Canada may not work in the United States or the EU.

  • We welcome client feedback on AI usage and adjust our practices to meet their preferences or concerns on a per-client basis.
