ACCEPTABLE USE POLICY

Evolving Media & Design Inc. (“Evolving Media”, “we”, “us”, or “our”) provides web hosting, design, photography, video, domain, and related digital services. This Acceptable Use Policy (“AUP”) sets out the rules that apply to anyone using our services, websites, servers, Client Care Portal, or network.

By using any of our services, you agree to comply with this AUP. Violation may result in suspension or termination of services, removal of content, and/or legal action, without prior notice where we deem it necessary.

1. Prohibited Content and Activities

You may not use our services to:

1. Post, store, transmit, or distribute any content that is illegal under Canadian or applicable law.
2. Post content that is obscene, pornographic, excessively violent, harassing, defamatory, threatening, or that promotes violence against individuals, groups, or organizations.
3. Infringe copyrights, trademarks, patents, trade secrets, or any other intellectual property rights of others.
4. Post content that holds Evolving Media, its staff, or affiliates up to public scorn or that damages our reputation.
5. Engage in fraud, pyramid schemes, or other deceptive or illegal commercial practices.
6. Host, store, or distribute child sexual abuse material (we will report any such material to law enforcement immediately).
7. Upload or distribute viruses, malware, worms, Trojan horses, or any other harmful code.
8. Engage in any activity that is tortious, including libel, invasion of privacy, or causing emotional distress.

2. Technical Prohibitions

You may not:

1. Use our services to launch or participate in denial-of-service attacks or otherwise degrade the performance of our servers or any other network.
2. Run scripts, programs, or processes that consume excessive CPU, memory, bandwidth, or disk space.
3. Maintain open mail relays or use our services to send unsolicited bulk or commercial email (spam).
4. Attempt to gain unauthorized access to any system, account, or network (including ours).
5. Forge headers, impersonate others, or engage in spoofing or other deceptive practices.
6. Conduct port scans or other invasive procedures against systems you are not authorized to administer.
7. Resell or provide unauthorized access to CGI scripts, mail services, or other resources on our servers.
8. Interfere with the Internet usage of other customers or third parties.

3. Spam and Unsolicited Email

Evolving Media has zero tolerance for unsolicited bulk email (UBE) or unsolicited commercial email (UCE).

• You may only send email to recipients who have given explicit, verifiable consent or with whom you have a valid existing business relationship under CASL.
• Open mail relays are strictly prohibited.
• Hosting websites or services that are advertised via spam is prohibited.
• Valid abuse complaints will be investigated. Failure to respond within 24 hours or repeated violations may result in immediate suspension or termination of services.

4. Copyright Infringement (DMCA)

Evolving Media respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and applicable Canadian copyright law.

If you believe material hosted on our servers infringes your copyright, please send a complete DMCA notice to our designated agent:

Your notice must include all elements required by 17 U.S.C. § 512(c). Knowingly submitting a false notice may result in liability for damages.

5. Reporting Abuse

To report a violation of this Acceptable Use Policy, please contact:

6. Changes to this Policy

We may revise this Acceptable Use Policy at any time. The current version will always be posted on our website. Continued use of our services after changes constitutes acceptance of the updated Policy.

7. Governing Law

This Policy is governed by the laws of Canada and the Province of Ontario.
